1. Introduction

Welcome to Sunset Mountains Resort, operated by Apuseni PeakView SRL, a company registered in Romania with the Trade Register Number J12/331/30.01.2020 and Tax Identification Code RO42184251.
These Terms and Conditions govern the contractual relationship between Apuseni PeakView SRL (“the Provider”, “we”) and you (“the Client”, “the Guest”). By accessing and using our services, you confirm your full and unconditional acceptance of these terms.
For details regarding the processing of personal data and the use of our website, please refer to the Privacy Policy and Terms of Use available on our website.

2. Conclusion of the Contract

By making a reservation and/or using the services offered by Sunset Mountains Resort, the Client confirms that they are at least 18 years old, have full legal capacity to enter into valid legal agreements, and fully and unconditionally accept these Terms and Conditions.
This act constitutes a valid contract between Apuseni PeakView SRL (Provider) and the Client (Guest), governed by these Terms and Conditions and the applicable Romanian legislation.
The Client undertakes to provide correct, complete, and truthful information during the booking process and throughout their stay.

3. Services Provided

3.1. Accommodation

• Check-in (Arrival):
  • Access to the property is permitted starting at 15:00 on the day of arrival.
  • Check-in is carried out only upon presentation of a valid identification document (ID card, passport, driver’s license) starting at 15:00. Refusal or inability to present a valid document may result in cancellation of the reservation and denial of access without any right to compensation.
  • Upon check-in, you will receive a house key. For safety reasons, please leave the key in the agreed place where you found it when you’re away from Sunset Mountains Resort. Loss or damage of the key entails replacement costs, estimated at 50 RON/key.
• Check-out (Departure):
  • Rooms must be vacated no later than 11:00 on the day of departure.
  • Access and presence on the property after check-out are allowed until 15:00 on the day of departure.
• Other facilities:
  • Sunset Mountains Resort does not have facilities for guests with reduced mobility (wheelchair access).
  • Rooms are not equipped with laundry services, television.

3.2. Activities and Relaxation Areas (Optional Services)

• Given Sunset Mountains Resort's location in a mountainous area, guests must be aware of and prepared for the conditions and potential risks specific to such an environment.
• Relaxation areas include a sauna, jacuzzi, hot tub and hammock zones.
• Access to these activities and relaxation areas may be restricted by the Provider and may involve additional costs as per the posted rates.
  The Provider also reserves the right to restrict access to certain property areas for safety reasons.
• Organization of optional activities depends on availability, weather, physical condition of participants, and other reasonable safety criteria.
  Signing the accommodation contract does not automatically guarantee access to these additional services.

4. Reservations, Modifications, and Cancellations

• Booking Confirmation:
  A reservation is considered firm and legally binding only after written confirmation (usually by email) from Sunset Mountains Resort and after full or partial payment as required by the offer.
• Booking Modification:
  Any change to a confirmed reservation is only possible with Sunset Mountains Resort’s express consent and subject to availability.
  Modification requests not approved do not entitle the Client to a refund.
• Provider’s Right to Refuse/Cancel:
  We reserve the right to refuse any booking request before confirmation, at our sole discretion.
  We also reserve the right to cancel a confirmed reservation for justified reasons (e.g., technical unavailability, force majeure), with full refund of advance payments for unprovided services.
  In such cases, our responsibility is strictly limited to refunding the amount paid, without further compensation.
• Client’s Cancellation and Refund Policy:
  • Confirmed and paid reservations are generally non-refundable.
  • Failure to show up (no-show) results in loss of all prepaid amounts.
  • No refunds will be issued for services included in the booking but not used (e.g., early departure).
  • In exceptional documented cases (e.g., visa denial, notified at least 20 days prior), a voucher may be offered under a specific policy.

5. Rates and Payment Methods

• Rates for accommodation, and additional services are those displayed on the website, or in the booking offer.
• Payments may be made:
  • Online, in advance, at the time of booking (for accommodation and packages).
  • At reception, during check-in or check-out, in cash (RON) or by card (Visa, Mastercard). For card payments, ID of the cardholder may be requested.
• All payments made at reception will receive a fiscal receipt. An invoice is issued upon request.
• Additional services used during the stay are usually paid at check-out, unless otherwise agreed.
• Transaction-related costs (e.g., bank fees) are borne by the Client.

6. Internal Rules and Prohibitions

For everyone’s comfort and safety, please observe the following rules:

• Relaxation Areas:
  Minors under 14 years old are not allowed in the sauna or hot tub areas unless accompanied by an adult.
  Equipment (sauna, hot tub) may only be operated by authorized staff.
  Moving existing hammocks or installing personal ones is not allowed.
  Violations may result in penalties (100 EUR/violation) and liability for damages.
• Objects and Equipment:
  Removing items from rooms or other Sunset Mountains Resort's spaces is forbidden.
  Using personal audio devices (portable speakers, phones, etc.) at high volume that may disturb others is prohibited.
• Photo/Video/Drone:
  Professional photo/video sessions or drone use require prior written consent from management.
  Unauthorized drone use is strictly forbidden and may result in legal action, contract termination, and a 500 EUR penalty per violation.
  Exceptions require both valid Romanian flight authorization and our express approval.
• Smoking:
  Smoking is only allowed in designated areas.
  Smoking inside buildings is prohibited and will incur a cleaning/penalty fee of 50 EUR.
  Improper disposal of cigarette waste or other litter is penalized similarly and may also lead to legal fines.
• Pets:
  Pets are allowed within Sunset Mountains Resort.
• Behavior:
  Excessive alcohol consumption, use of illegal substances, aggressive or inappropriate behavior disturbing other guests or staff are strictly prohibited.
• Consequences of Non-Compliance:
  Serious or repeated violations of these Terms or conduct rules may lead to immediate contract termination, eviction, and forfeiture of all payments made, without compensation.

7. Liability

• Provider’s Responsibility:
  We assume responsibility for direct damages caused to the Client by our exclusive fault or that of our employees, within legal limits and proven by the Client.
  Our liability will not exceed the value of the contracted services, except as expressly required by law.
  We are not responsible for indirect or future damages suffered by guests.
• Limitations of Liability:
  • The Client assumes all risks associated with traveling to and using facilities in a mountainous environment.
  • The Provider informs Guests that local natural spring water is not continuously tested for potability. Sunset Mountains Resort cannot be held responsible for its quality and recommends bottled water consumption.
  • Due to the mountain location, the presence of wildlife (including insects, snakes) and native flora (some species potentially toxic) is natural and beyond our control. Sunset Mountains Resort is not liable for any interactions; guests are advised to act cautiously.
  • We are not responsible for loss, theft, or damage of guests’ personal belongings left in rooms or common areas. No secure storage for valuables is provided.
  • We are not liable for injuries or damages resulting from failure to follow warnings, posted instructions, or staff guidance.
• Client’s Responsibility:
  • The Client is directly responsible for any material or moral damage caused to the property, equipment, staff, other guests, or third parties, by themselves, their companions (including minors), or those under their supervision.
  • The Client must fully compensate for any damage, including moral or reputational harm.
  • The Client must supervise minors accompanying them at all times.

8. Force Majeure and Fortuitous Events

Neither party shall be held liable for delayed, improper, or partial non-performance of obligations if caused by force majeure or fortuitous events as defined by law (e.g., war, natural disasters, fire, floods, strikes, legal restrictions, pandemics, extreme weather affecting infrastructure, unforeseen utility outages).
The party invoking force majeure must notify the other party within a reasonable time and take all possible measures to minimize consequences.

9. Consumer Protection and Dispute Resolution

• We are committed to respecting consumer rights in accordance with Romanian and EU legislation (e.g., Government Ordinance 34/2014, EU Consumer Rights Directive, EU Directive on Unfair Commercial Practices).
  We ensure that all advertising and pre-contractual information is accurate and transparent.
• Complaints:
  Any complaint regarding our services can be addressed to the management team on-site or in writing at the contact details below. We will make every reasonable effort to resolve any issue amicably.
• Alternative Dispute Resolution:
  If a dispute cannot be resolved amicably, the Client (as consumer) has the right to appeal to the Alternative Dispute Resolution (ADR) mechanisms offered by the Romanian National Authority for Consumer Protection (ANPC).
  For cross-border online disputes, the European ODR platform may be used.

10. Amendments to the Terms and Conditions

We reserve the right to modify these Terms and Conditions unilaterally at any time.
The updated version will be published on our website and/or displayed at reception.
Continued use of our services after the effective date of changes constitutes tacit acceptance of the new terms.
For confirmed reservations, the terms in effect at the confirmation date apply, unless changes are legally required.
